These terms explain the rules for using collisionassistant.com and our repair shop matching, claim coordination and text message services. Please read them along with our Privacy Policy.

Agreement to these terms
These Terms and Conditions (“Terms”) are an agreement between you and Collision Assistant LLC (“Collision Assistant,” “we,” “us” or “our”). They apply when you use collisionassistant.com, submit a form, list a repair shop, refer a client, or receive calls, emails or text messages from us.
By using our website or services, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use our services.
What Collision Assistant does
Collision Assistant helps California drivers find vetted collision repair shops after an accident and coordinates the vehicle side of their claim, including repairs, rental cars, towing, total loss and diminished value paperwork. Our service is free for drivers. We also handle property damage claims for clients referred by personal injury law firms, and we list repair shops in our network.
Collision Assistant is not a law firm, insurer or medical provider. We do not give legal, insurance or medical advice, and nothing on our website or in our messages should be treated as that kind of advice. For legal questions, speak with a licensed attorney. For questions about your coverage, speak with your insurance company.
Who can use our services
You must be at least 18 years old to use our services. You agree to give us accurate and current information and to update it if it changes.
If you submit information about someone else, such as a law firm sending a client’s details or a family member helping with a claim, you confirm that you have that person’s permission to share it with us.
Repair shop matches
- Shops are independent businesses. The repair shops in our network are not owned, employed or controlled by Collision Assistant.
- We review shops, but we do not perform repairs. We check shops before adding them to our network, but we do not guarantee the quality, cost, timing or outcome of any repair.
- Your repair agreement is with the shop. Any estimate, repair authorization, warranty or payment is between you and the shop you choose.
- The choice of shop is yours. You can use any shop, including one outside our network. Under California Insurance Code Section 758.5, an insurer cannot require you to have your vehicle repaired at a specific shop.
If you have a concern about a repair, tell us and we will try to help. You can also file a complaint with the California Bureau of Automotive Repair.
Claim coordination
When you ask us to coordinate your vehicle claim, you authorize us to communicate about your vehicle and claim with your insurance company, the other driver’s insurer, repair shops, towing and rental companies, and your attorney if you have one. You can withdraw this authorization at any time by telling us in writing.
Insurance companies decide whether a claim is covered and how much they pay. Any estimate, valuation or diminished value figure we provide is for your information and is not a promise of what an insurer will pay. If an attorney represents you, we work at your attorney’s direction and send any legal questions back to them.
Law firm referrals
When a law firm refers a client to us, the firm confirms that it has the client’s permission to share their information, that the case details it provides are accurate, and that the firm remains responsible for all legal advice and representation. If fees apply to services we provide to a law firm, they are set out in a separate written agreement between the firm and Collision Assistant.
Text message terms (SMS)
By opting into SMS from a web form or other medium, you agree to receive SMS messages from Collision Assistant LLC. This includes conversational SMS messages about your request. How you opt in
You opt in by checking the text message consent box on a form on our website, such as our contact form, or by sending a text message to our number first. The consent box is never pre-checked, and you do not have to check it to submit a form or use our services. Agreeing to receive text messages is not a condition of any service or purchase.
What we text you about
Our messages relate to your own request. They include replies to your questions, your repair shop match, estimate and appointment updates, requests for documents or photos, and claim status updates. We do not send promotional text messages unless you separately agree to receive them.
How to stop messages
Reply STOP to any message to opt out. You can also reply UNSUBSCRIBE, CANCEL, END or QUIT. You will receive one final message confirming that you are unsubscribed, and we will not text you again unless you opt back in. To opt back in, check the consent box on our website again or text us.
How to get help
Reply HELP to any message, visit www.collisionassistant.com or contact us using the details in section 18.
Your phone number
You confirm that you are the account holder for the mobile number you give us, or that you have the account holder’s permission to use it. If you change or give up that number, please tell us so we can stop texting it.
Delivery and carriers
Mobile carriers are not liable for delayed or undelivered messages. We cannot guarantee that every message will be delivered.
Privacy
We handle your mobile number and consent as described in our Privacy Policy. No mobile information will be shared with third parties or affiliates for marketing or promotional purposes.
We use reasonable administrative, technical and physical safeguards to protect your information, including encrypted connections on our website and access limited to the staff who need it to do their jobs. No method of storing or sending information is completely secure, so we cannot guarantee absolute security.
Repair shop listings
Listing a repair shop in our network is free. If you list a shop, you agree that:
- The information you give us about the shop is accurate and you will keep it up to date.
- The shop holds all licenses and registrations it needs to operate, including a valid Automotive Repair Dealer registration with the California Bureau of Automotive Repair.
- The shop follows all laws that apply to its work, including California rules on written estimates and repair authorizations.
We may edit, suspend or remove a listing at any time, for example if information is inaccurate or we receive complaints. A listing does not create a partnership, employment or agency relationship between the shop and Collision Assistant.
Acceptable use
When you use our website and services, you agree not to:
- Submit false information, or someone else’s information without their permission.
- Use our services for anything unlawful, fraudulent or harmful.
- Copy or collect our shop directory or website content with bots, scrapers or other automated tools.
- Try to break into, overload or interfere with our website or systems.
- Send spam or unwanted messages through our forms.
We may suspend or end your access to our services if you break these rules.
Our website content
The text, articles, graphics, logos and design on collisionassistant.com belong to Collision Assistant or are used with permission. You may view and share our pages for personal, non-commercial use. You may not copy, republish or sell our content without our written permission.
Our articles and guides offer general information about car accidents, repairs and insurance claims. They are not legal, insurance or medical advice.
Links to other websites
Our website links to sites we do not control, such as repair shop websites and government resources. We are not responsible for their content, services or privacy practices.
Disclaimers
To the fullest extent the law allows, our website and services are provided “as is” and “as available,” without warranties of any kind, whether express or implied. We do not promise that the website will always be available or free of errors, or that any repair, claim or insurance outcome will meet your expectations.
Limitation of liability
To the fullest extent the law allows, Collision Assistant is not liable for any indirect, incidental, special or consequential damages arising from your use of our website or services. We are also not responsible for the acts or omissions of repair shops, insurers, law firms, towing companies, rental companies or other third parties.
Our total liability for any claim related to our services is limited to the greater of the amount you paid us in the 12 months before the claim or $100. Nothing in these Terms limits any liability that cannot be limited under California law.
Indemnification
You agree to cover any losses, claims or costs, including reasonable attorney fees, that we face because you broke these Terms, misused our services or gave us information you did not have the right to share.
Governing law
These Terms are governed by the laws of the State of California. Any dispute related to these Terms or our services will be handled in the state or federal courts located in Los Angeles County, California.
Changes to these terms
We may update these Terms from time to time. When we do, we will change the “Last updated” date at the top of this page, and we will post a notice on our website for any significant change. If you keep using our services after an update, you accept the updated Terms. We will tell you before making any significant change to our text message program.
General terms
These Terms and our Privacy Policy are the full agreement between you and Collision Assistant about our website and services, unless you have signed a separate written agreement with us. If any part of these Terms cannot be enforced, the rest still applies. If we do not enforce a part of these Terms right away, we have not given up the right to enforce it later.
